Terms, Conditions & General Info 2020
Please carefully read the Terms, Conditions & General Information contained in these pages. They outline the terms under which Go Touch Down tours will operate, and they limit our liability. Payment of deposit and/or final payment is an acknowledgment of receipt of these terms & conditions and constitutes acceptance of such as outlined. Deposits, Payment terms, Final Payments and Reservations: A minimum deposit is due to Go Touch Down at the time of signing our Sale Agreement. The deposit may vary depending on the tour being purchased and will be reflected in our Sale Agreement. An Invoice will be forwarded to you upon receipt of your deposit. Go Touch Down provides payment terms for the remaining balance. The terms and conditions of the payment plan may vary depending on the tour being purchased and is reflected in our Sale Agreement and the Sale Obligation. Full payment of any outstanding amount is due prior to the commencement of any of our tours. The exact date on which full payment may be required may vary depending on the tour being purchased and will be reflected in our Sale Agreement. If the Sale Agreement is signed within the last 60 days of departure (and if space is still available), the entire tour price must be paid at the time of signing our Sale Agreement. Our tours tend to sell out fast, and as such, early reservations are essential to ensure availability of space.
Prices, Rates, Fares: Unless otherwise indicated, all prices shown are in Australian Dollars and are stated per person per tour. Prices may fluctuate from time to time and may be subject to change at any time prior to departure depending on the tour being purchased. Certain tour prices do not fluctuate. Price fluctuation policies are reflected in our Sale Agreement. Airfares are not included in the quoted tour prices and any airfares which are stated are only examples and not guarantees of available airfares.
Travel Documents: All participants must be in possession of a passport valid for 6 months beyond the re-entry date into Australia. A visa or visas may be required for some or all of the countries visited on the holiday or tour selected. Please check your visa requirement/s at time of reservation. Go Touch Down will provide visa information. Non Australian Citizens may have different requirements. It is the passenger’s responsibility to ensure that all his or her visa and passport requirements are met. Please note that in the event travel advisories are issued by any government or applicable authority and the tour is not cancelled by Go Touch Down or by tour member (which will be subject to cancellation fees), the member assumes and accepts all risk of travel, related to the travel advisory or otherwise.
Tour Information: Acknowledgement of reservation will be sent immediately upon initiation of a reservation. Final tour documents (consisting of some or all of a detailed tour itinerary, hotel list, baggage tags, etc.) are dispatched from our offices approximately 21-30 days prior to departure.
Cancellations & Changes: Go Touch Down reserves the right to cancel any tour at any time, and in such event, the liability of Go Touch Down is limited to the return of monies paid to it by any tour member. Cancellations by tour members are restricted. Due to the special nature of the programs and tours featured by Go Touch Down suppliers impose rigid cancellation fees; please be aware that Go Touch Down will levy a cancellation fee of 30% on all processed cancellations. All payments made to Go Touch Down are non-refundable and will be deducted from the cancellation fee. Notice may also be sent via email to email@example.com. The reason for the cancellation must be stated in the notice, as your cancellation may be covered by your travel insurance policy if you have obtained one.
To protect against cancellation charges, we strongly recommend purchasing Cancellation Protection and Travel Interruption Insurance (see Insurance clause). Go Touch Down and/or its agents are not responsible for any damage, expense or inconvenience caused by late departures, security delays, change of schedule, or other acts or conditions excluded herein.
Unused Tour Items: No refund will be made for any unused accommodations, missed meals, transportation segments, cruise portions, sightseeing tours or any other service. Such unused items are neither refundable nor exchangeable (no exceptions).
Insurance: Go Touch Down strongly recommends that you obtain Travel Protection Insurance, which will protect you and your investment in the event of a medical emergency before or during your trip and offers coverage for trip cancellation or interruption, government travel advisories, illness, injury, and damage, loss or theft of baggage, as well as on site emergency assistance. Such insurance is available from many sources including travel agents and other online insurance services. We also suggest that you review any existing health insurance coverage available to you to determine the level of coverage, if any, that you will have in a foreign country. Go Touch Down is not responsible for the costs of any medical treatment required during the tour, nor is Go Touch Down responsible for the quality, or lack thereof, of medical care a tour member may receive while on tour.
Health Requirements: Health regulations for some countries visited on featured tours in this brochure may require proof of inoculation and/or vaccination certificate; such a certificate should be in your possession throughout the entire tour. Go Touch Down strongly recommends that you consult with your personal physician in regards to your itinerary and required inoculations.
Revision Fees: Any name change to transportation or lodging reservations (including airline tickets) including minor spelling corrections may require that such reservations be cancelled and re-booked. Tour member agrees that the names on the reservation form as given to Go Touch Down are spelled correctly per the tour member’s passports. In the event that names as listed on the form are incorrect then the tour member agrees to any expenses resulting out of the cancellation and re-booking of such transportation and lodging reservations.
In Tour Transportation: Deviations to any planned motor coach, cruise or rail itineraries are possible, although every effort will be made to keep them as they are shown. All itineraries are subject to change without notice. Should conditions render transportation routes unsafe for navigation or passage, alternative services may apply, including but not limited to, alternate lodging accommodation and/or substitute transportation arrangements.
Accommodations: Accommodations will be provided at the property specified or similar. Rooms will be assigned by the respective supplier/s in accordance with their standard policies, in category/ies as specified in the itinerary. The hotels and/or resorts featured in the itinerary will be in accordance to the level of the program – Superior, Deluxe or Luxury (this term may be defined by the hospitality industry in the region providing such accommodation or by trade custom).
Meals: Meals for each tour are included as stated on itinerary. A La Carte, buffet meals and/or table d’hôte are offered. Special meals and entertainment are included as shown in the itinerary. In some rare instances, a meal may not be of a standard expected under the term of “deluxe” particularly in remote areas. Special meal requests (including vegetarian) are not guaranteed; please identify any dietary restrictions you may have prior to departure and in writing.
Sightseeing & Land tour Services: The following services are included in your tour price: In-tour transportation, baggage handling, sightseeing with English-speaking guides (as mentioned in the itinerary) and all entrance fees to attractions visited (as described in the itinerary). Sightseeing will be via motor coach, private car and other modes of transportation (air conditioned where necessary and available), as determined by the nature of the terrain and as outlined in the itinerary. Transfers are not included when arriving or departing at the first destination gateway by means other than the scheduled tour flights, if any, but can be arranged at additional cost.
Special Entertainment: Cultural entertainment events, gala evenings and/or festivals are included as per the itinerary.
Non-refundable Air Tickets: For any departures that are not guaranteed: If you are purchasing a non-refundable air ticket, please make sure that your travel agent explains the difficulties associated with these airfares. Go Touch Down cannot be held responsible for any change/cancellation penalties associated with non-refundable airfares.
Luggage: In-tour ground travel arrangements include transportation and transfer of no more than two standard-sized suitcases per person. In-tour airline travel may restrict the size and number of luggage pieces, and/or impose additional charges which will be the responsibility of the tour member. Please be aware that airline restrictions on luggage vary by airline, location and custom in the industry, and your travel agent should provide you with all applicable regulations prior to departure. Go Touch Down will use reasonable efforts to notify you of any in-tour luggage restrictions prior to departure.
Baggage Risks: Baggage and personal effects are at owner’s risk throughout the tour and baggage insurance is strongly recommended (see insurance clause). Carrier liability for tour members’ baggage is clearly stated on the passenger contract printed on all tickets; description can also be found on carrier websites. Liability for checked and unchecked baggage shall in no event exceed the actual loss incurred by the passenger, subject to proof of the amount of loss, and Go Touch Down is in no way liable for any losses. Please read all of the conditions of your ticket. Federal law and treaties limit the amount of recovery for loss of or damage to your luggage or its contents. To protect against such limitations, we strongly recommend that you purchase insurance (see insurance clause).
Tour Price Exclusions: Your tour price does not include: Air transportation (unless specifically stated as included); costs and fees to obtain or extend your passport/s; visa fees and processing fees; inoculations and vaccinations (if required); health certificate; airport taxes and country departure taxes (if applicable); all items of a personal nature including alcoholic beverages (except on certain occasions); meals not specified, tips to tour guides; excess baggage charges; cancellation, health, accident and baggage insurance; private, non-group transfers; and any items not specifically listed as included.
Photography: Go Touch Down reserves the right to take photographs during the operation of any program and to use resulting photographs for promotional purposes. Any passengers who prefer that their images not be used are asked to notify their tour escort at the beginning of the program.
Responsibility – Limitation of Liability: Go Touch Down of Queensland, Australia and all affiliates act only in the capacity as a tour operator and arranges with third party contractors and service providers providing accommodations, transportation or other services to the tour member. Go Touch Down makes every effort to select quality suppliers of the aforementioned services. However, Go Touch Down does not control the operations of these agents and as a result, cannot be held liable for any personal injury, property damage, or other claim which may occur as the result of any and/or all of the following: (1) the wrongful, negligent or arbitrary acts or omissions on the part of the independent supplier, agent, its employees or others who are not under the direct control or supervision of Go Touch Down ; (2) defects or failures of any vessel, aircraft, vehicle or other instrumentality which is under the control of an independent supplier; or (3) loss, injury or damage to person, property or otherwise, resulting directly or indirectly from any Acts of God, weather, government actions, dangers, incidents during transportation, fire, breakdown in machinery or equipment, or wars (whether declared or not), hostilities, civil disturbances, strikes, riots, thefts, pilferage, medical epidemics, quarantines, or customs regulations, defaults, delays or cancellations or alterations in itinerary and/or lodging due to schedule changes or capacities, or from any causes beyond Go Touch Down control. Further, Go Touch Down is not liable for any loss or damage resulting from insufficient or improperly issued passports, visas or other legal documents.
Regardless of anything herein to the contrary, tour members agree that maximum liquidated damages shall not exceed the tour price. In no event shall the liability of Go Touch Down exceed the actual cost of any services not provided, and Go Touch Down hereby disclaims any responsibility for revisions, substitutions, omissions which are the result of the actions or inactions of any third parties providing services or products for the applicable tour or package. The tour member further agrees that Go Touch Down shall not be liable or responsible for other consequential losses or other damages or expenses that the tour member has incurred in anticipation of or in connection with the tour.
Reservation of Rights: Go Touch Down (when deemed necessary in its sole discretion) reserves the right to: (1) cancel any itinerary or any part of it for any reason; (2) make any alterations to the itinerary (including, but not limited to, alterations or substitution of hotels); and (3) decline to accept or to retain any person as a tour member should such person’s health, mental or physical condition, in the sole opinion of Go Touch Down, impede the operation of the tour of the other passengers. Tour members may be restricted by Go Touch Down or third party services providers or applicable law or regulation from smoking, certain behaviours, photography or other actions due to cultural issues and enjoyment of the tour by other tour members. Tour members are held responsible for being in sufficient good health and capacity to undertake the tour. Persons needing individual assistance for walking, dining, or other personal needs must be accompanied by an able companion and must notify Go Touch Down in writing at the time of booking. Certain trips and features may not be wheelchair accessible. If you require a wheelchair, you must provide your own small collapsible wheelchair. In international destinations, Company cannot guarantee wheelchair accessibility. If a tour member is asked to leave while the tour is in progress, due to any condition or action that becomes a nuisance to other tour members or detrimental to their enjoyment of the tour, that person will be responsible for charges incurred on account of such departure from the tour and/or their return to Indonesia. In such a case, Go Touch Down will use its best efforts to obtain a refund of any monies that can be recovered for the unused portion of the tour, taking into account additional charges incurred by Go Touch Down and cancellation or modification charges of third parties. There can be no guarantee that any such sums can be recovered or refunded. Other than to refund such sum, Go Touch Down will accept no further liability or obligation toward that person or third party.
Disclaimer: Go Touch Down is not responsible for any errors, omissions, or misquotes contained in this brochure or any other accompanying promotional documentation. The contents of said brochure or promotional documentation may be changed at any time (including, but not limited to, rates and itinerary) without notice and at the sole discretion of Go Touch Down. In the event that an error or omission committed by the Go Touch Down or its employees results in the paid booking of the tour member on an incorrect vacation package, price, date, or other similar error, Go Touch Down reserves the right, when practicable, to re-invoice with correct pricing and the tour member agrees to be subject and bound to the subsequent price, or the tour member may also elect to receive a full refund for all monies that have been paid to the Go Touch Down in such an event. The tour and stipulated member further agrees that the Go Touch Down shall not be responsible or held liable to secure the originally intended vacation package, which in many cases may not be available or its procurement may not be practicable due to forces of nature, market factors, or other related reasons.
Venue: It is specially agreed that this agreement is entered into in Australia. In the event any legal or equitable action is brought against Go Touch Down concerning the interpretation, enforcement or breach of any term, obligation or duty as contained or related to the terms and conditions set forth in this web site, or pursuant to federal law, statute or treaty to which Australia is a signatory, the venue of such action shall lie exclusively in Queensland, Australia.
Choice of Law: It is specifically agreed and stipulated that the law of the state of Queensland shall govern and apply to any legal or equitable action brought against Go Touch Down concerning the interpretation, enforcement or breach of any term, obligation or duty contained in this web site, or pursuant to any federal law, statute or treaty to which Australia is a signatory.
Changes and Addendums to the Contract;
No changes to the contract, and or any addendum thereto, are enforceable unless reduced in writing and signed by all parties.
